Choosing the Right Case Can Save You Time
In Missouri, landlords typically have two options when filing for eviction:
👉 Rent & Possession or👉 Unlawful Detainer
Understanding the difference isn’t just technical — it can directly impact how fast you regain possession and how much resistance you face in court.
🏠 Rent & Possession
This is the most common filing when:
The tenant is still under a lease, and
They’ve failed to pay rent
You’re asking the court for:
Possession of the property, and
A judgment for unpaid rent
The downside:Tenants have more available defenses, such as:
Payment disputes
Habitability claims
Procedural challenges
These defenses can slow the case down and sometimes require a trial.
🚪 Unlawful Detainer (UD)
This applies when the tenant no longer has a legal right to be in the property, such as:
The lease has expired, or
You’ve properly terminated the tenancy with notice
At that point, the tenant is simply holding over.
The advantage:👉 Very limited defenses👉 Focus is almost entirely on right to possession
Because of this, UD cases are often:
Cleaner
More straightforward
Faster to resolve
💡 Strategic Consideration
In some situations, it may make sense to:
Terminate the lease first, then
File an Unlawful Detainer case after the notice period, or
Wait for the lease to expire before filing
Why? Because shifting the case into UD can reduce the tenant’s ability to delay the process.
⚠️ But Be Careful
This strategy only works if:
Notice is properly given, and
Timing is handled correctly
Filing the wrong case — or filing too early — can cost you weeks.
